These Terms of Service ("Terms") are a binding agreement between you and Helixx Consulting, LLC ("we," "us") governing your use of The Lantern Society web application at lanternsociety.net (the "App"). By using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with a parent's or guardian's permission. The App is not directed to children under 13. By using the App you represent that you meet these requirements.
Sign-in uses your email and a one-time code. You are responsible for activity under your account and for keeping access to your email secure. Tell us promptly at contact@lanternsociety.net if you suspect unauthorized use. Do not impersonate others or pick an Agent name that is offensive or infringing.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial enjoyment, subject to these Terms. We may update, change, or discontinue the App or any feature at any time.
The App uses your real-world location and encourages you to walk and explore. Your safety is your responsibility.
You assume all risks of your real-world activity while using the App, to the fullest extent permitted by law.
You agree not to:
"User Content" means anything you submit, including Field Reports, images or drawings, books, and your Agent name.
The App and its content (excluding User Content), including the name "The Lantern Society," the Veilglass, the artwork, entity designs, text, and software, are owned by us or our licensors and protected by intellectual-property laws. You may not copy, distribute, or create derivative works from them except as expressly allowed.
If you believe content on the App infringes your copyright, contact contact@lanternsociety.net with the subject line "Copyright notice" and the information required under applicable law (identification of the work, the material, your contact details, and a good-faith statement). We respond to valid notices and may remove infringing content and terminate repeat infringers.
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or secure, or that location or AR features will be accurate.
To the fullest extent permitted by law, Helixx Consulting, LLC, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your real-world activity while using the App, your User Content, or your inability to use the App. Our total liability for any claim relating to the App will not exceed the amount you paid us in the past 12 months, or USD $50 if you paid nothing. Some jurisdictions do not allow certain limitations; those limitations may not apply to you.
You agree to indemnify and hold harmless Helixx Consulting, LLC, from claims and costs arising out of your use of the App, your User Content, or your violation of these Terms or any law or third-party right.
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the App or its users. Sections that by their nature should survive (ownership, disclaimers, liability limits, indemnity, governing law) survive termination.
These Terms are governed by the laws of the United States and of the operator's home state, without regard to conflict-of-laws rules. The venue and dispute-resolution approach will be finalized on legal review of these beta Terms.
We may update these Terms. We will post the updated version with a new "Last updated" date and, where appropriate, notify you in the App. Continued use after changes means you accept them.
